Complete Care TV campaign, August 2019

PARTIES

  1. These terms and conditions (“T&Cs”) are between you, as a submitter of footage (“you”, “your”, “yours”), and Pets at Home Vet Group Ltd (UK company registration number 08595290) of Epsom Avenue, Stanley Green Trading Estate, Handforth, Cheshire, SK9 3RN (“we”, “us”, “our”).
  2. We work with third party creative agencies and production companies in order to produce our campaigns, and any footage submitted to us may be shared with such third parties at any time. References to “we”, “us” and “our” in these T&Cs may therefore include such third parties connected to us from time to time.

ACCEPTANCE OF THESE TERMS

  1. By sending footage to us, you agree to be bound by these T&Cs.

HOW TO SUBMIT

  1. To submit your footage, please send the following via private direct message to the @Vets4PetsGroup Facebook account
    1. your footage (which should meet the requirements listed at paragraphs 7 and 8 below),
    2. your name, and
    3. the name(s) of the pet(s) featured in the footage.
  2. Your footage must be sent to us before the closing date of 28 August 2019 to be considered for use in our October 2019 TV campaign for the Complete Care Health Plan (the “CC Campaign”).

SUBMISSION RESTRICTIONS

  1. To send us footage you must:
  2. be a UK resident;
  3. be at least 13 years old at the time of entry. Participants under the age of 18 must have permission from a parent/legal guardian to participate and must be able to evidence this permission if requested. If you are under 18 then please make sure your parent/legal guardian has read these terms and conditions with you before you submit footage – your parent/guardian will be subject to these terms and conditions if you submit footage; and
  4. have the permission of every person featured in your footage to submit the footage to us.
  5. Footage submitted must:
  6. be your own work and original creation;
  7. not contain any third party materials or content, unless proper permission has been given to use such third party materials or content;
  8. not infringe or otherwise violate the copyright, trade mark, privacy or other intellectual property of any third party; and
  9. be free from viruses and other malware.
  10. Footage submitted must not, in our reasonable opinion:
  11. contain any offensive content; or
  12. reflect negatively on us or any member of the Pets at Home Family, being:
    1. Pets at Home Vet Group Limited,
    2. Companion Care (Services) Limited,
  • Companion Care Management Services Limited,
  1. Vets4Pets Limited,
  2. our network of affiliated joint venture first opinion veterinary practices branded either Companion Care or Vets4Pets,
  3. Pets at Home Veterinary Specialist Group Limited,
  • Anderson Moores Veterinary Specialists Limited,
  • Dick White Referrals Limited,
  1. Northwest Veterinary Specialists Limited,
  2. Eye-Vet Limited,
  3. Pets at Home Limited (including its retail stores, retail website and apps, the Groom Room and VIP Club), and
  • Pets at Home Group plc, and
  • Support Adoption For Pets, our affiliated charity;
  1. promote any political agenda; or
  2. contravene any aspect of these T&Cs.
  3. By sending us footage, you confirm and represent to us that you and your footage meet the eligibility criteria at paragraphs 6 to 8 of these T&Cs.

USE OF CONTENT

  1. By sending us footage, you:
    1. grant us a perpetual worldwide, non-exclusive, royalty-free, transferrable, sub-licensable, unrestricted licence to use your footage and agree to us reproducing, distributing, modifying, displaying, performing and publishing your footage at any time without notice and without any fee being paid via:
      1. our website,
      2. Facebook, Twitter, Instagram, and/or other social media platforms,
  • media of our choosing, including television broadcasting, advertising and other print or digital media.
  1. waive all moral rights to which you may now or at any future time be entitled under the Copyright, Designs and Patents Act 1988 as amended or replaced from time to time.

FACEBOOK

 

  1. If you have been made aware of this campaign via Facebook, then:
    1. by sending us footage, you release Facebook from any liability and you acknowledge that the footage, this campaign, and any of our future campaigns are in no way sponsored, endorsed, administered by or associated with Facebook, and
    2. you agree that it is your own responsibility to ensure you comply with the Facebook rules and any other rules, policies, guidelines and/or agreements with or published by Facebook.

DATA PROTECTION

  1. All personal information received by us will be used in accordance with the Pets at Home Vet Group privacy policy (found at: https://www.vets4pets.com/about-us/privacy-policy/).
  2. If we want to use your footage as part of any current or future campaign, we will contact you via the Facebook account you used to submit your footage and ask for your consent and the consent of any other individuals featured in the footage.
  3. Even if we don’t use your footage in any campaign, we will retain all footage submitted to us until 31 December 2021. If we want to retain or use your footage after this date, we will contact you via the Facebook account you used to submit your footage and ask for your consent and the consent of any other individuals featured in the footage to retain and/or use the footage.
  4. You can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we have conducted prior to your withdrawal.

 

GENERAL

  1. We cannot accept any responsibility for any submission not received for whatever reason.
  2. We give no guarantees that any footage received will be used in any current or future campaigns.
  3. Nothing in these T&Cs excludes or limits any party’s liability for death or personal injury, fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited by law.
  4. These T&Cs will be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these T&Cs.
