Contract Details
These are the Terms and Conditions for the Care4Pets Healthcare Plan run by Vets4Pets Services Limited, a company incorporated in England and Wales whose registered office is at:
Epsom Avenue, Stanley Green Trading Estate, Handforth, Cheshire, SK9 3RNCompany Number 05055601.
By signing up to the Care4Pets Healthcare Plan you warrant that you are a consumer (being a person acting outside the course of his or her business or trade). Nothing in these terms and conditions affects any statutory rights you may have as a consumer (details of which are available from your local citizen’s advice bureau). For example, under the Supply of Goods and Services Act 1982 or the Consumer Rights Act 2015, the Services (as defined below) must be supplied to you with reasonable skill and care. Nothing in these conditions seek to limit or exclude such rights. Please read through the following terms and conditions before signing up to the Care4Pets Healthcare Plan.
- In this contract: ‘we’, ‘us’, or ‘our’ means the Vets4Pets veterinary practice named on the Registration Form; ‘Animal Healthcare’ means The Animal Healthcare Company Limited (company number 3302348); ‘contract’ means contract formed between you and us in respect of the Services and including these terms and conditions and the Registration Form (including the Animal HealthCare terms and conditions set out in it); ‘pet’ means the pet noted in the Registration Form who is able to receive the Services; ‘Registration Form’ means the registration form in relation to the Services to which these conditions are attached; ‘Services’ / ‘Care4Pets Healthcare plan’ means the Care4Pets Healthcare Plan preventative healthcare services and products for your pet as noted in the Registration Form and further details of which are available from us; ‘you’ or ‘your’ means the person named as the owner on the Registration Form.
2. In consideration of the payment by you of the charges noted in the Registration Form we shall supply you with the Services that you may require for your pet from time to time during the term of this contract.
3. The Care4Pets Healthcare plan does not prevent your pet from receiving treatment or services and products which are not included in the plan. You will be responsible for paying for such treatment, services and products at the prevailing list prices.
4. There is no insured benefit. THIS IS NOT AN INSURANCE POLICY.
5. Care4Pets Healthcare Plan only applies to the named pet on the Registration Form and is not transferable between pets.
6. Your Care4Pets Healthcare Plan is valid with us, or with any other practice in the Vets4Pets Group who participates in the Care4Pets Healthcare Plan Services. Where you choose for your pet to have routine care or treatment provided by a practitioner independently which is not part of the Vets4Pets Group, your pet’s treatment will not be covered by your Care4Pets Healthcare Plan.
7. The Care4Pets Healthcare Plan is available at participating Vets4Pets practices only.
8. In addition to the payment charge noted below, you must pay your initial Care4Pets Healthcare Plan joining fee to us at the time of joining.
9. Personal data that you provide to us in respect of this Service will be held by us in a database accessible to us, our affiliates and Vets4Pets Partners and will be used for the purpose of providing the Care4Pets Healthcare Plan services and products to you. Unless you have told us that you do not receive such contact, we may occasionally contact you in respect of similar services. You may tell us at any time not to contact you in this
way. Please contact us at the address noted in the Registration Form if you would prefer not to be contacted this way.
10. The scheme is payable by direct debit installments at the prices noted in the Registration Form, which payments will be managed by ‘Animal HealthCare’ on behalf of Vets4Pets. You will be required to complete and sign the forms required by Animal Healthcare, including the Direct Debit mandate form. Once we have received confirmation that your banking details are correct your Care4Pets Healthcare Plan will be activated and the contract between you and us will be formed. We will provide you with notice of the activation date.
11. It is your responsibility to read and comply with the terms and conditions provided by Animal HealthCare and set out in the Registration Form.
12. Animal HealthCare will manage your Direct Debit payment(s) and we will share your details with it for this purpose only.
13. We may terminate this contract if you fail to make payments due under it (in accordance with clause 15 below) or if, in our reasonable opinion, you (and/or any person who brings the pet to us in relation to the Services) are aggressive and/or abusive to any of our staff.
14. In circumstances where we have cancelled the contract in the circumstances noted at clause 13 above (and where we have agreed to refund, through Animal Healthcare, any amount of the Care4Pets Healthcare Plan fees as a result of this cancellation) and we have performed any of the Services, you must pay us the full list price for the Services that we have performed, as such list prices are set out in our practice. Animal HealthCare will administer the refund on behalf of your practice.
15. If Animal Health Care is unable, because of a default by you, to collect a payment they will inform you accordingly and will attempt to collect the failed payment having given you adequate notice in writing of the new payment date. If you default on two successive payments, Animal Health Care will inform you your Plan has been subsequently cancelled.
16. Your pet’s health check notifications and reminders will be delivered directly to the address provided on the Registration Form at our practice. Please note that it is your responsibility to notify us if you change your address.
17. We may review and apply price increases to the Care4Pets Healthcare Plan. You will be informed in writing at least 28 days before any price change takes effect and will be given the option of terminating this contract without payment of a cancellation fee prior to any price increase coming into effect. Correspondence sent to the last known address by ordinary post will be treated as adequate notice.
18. If you join the Care4Pets Healthcare Plan and subsequently move to another town with a Vets4Pets practice your plan will be transferred to the new Vets4Pets practice on your request provided that the relevant practice is participating in the Care4Pets Healthcare Plan scheme. You will not be required to pay the joining fee again; however you will be required to complete a new Registration Form.
19. It is your responsibility to ensure you attend the appointments suggested by us and no financial compensation will be given if reminders are not acknowledged.
20. It is your responsibility to ensure that you fully understand what is required for each appointment, for example if you are required to provide a urine sample from your pet. If you need assistance please do not hesitate to speak to a member of our staff.
21. Any urine sampling kit damaged in transit to you should be notified to us within 24 hours to your practice. Your practice will arrange for a replacement to be sent as soon as possible.
22. You are responsible for ensuring your pet attends our practice regularly and that you comply with the treatment, service and products we prescribe for your pet. If, in our reasonable opinion, we are not able to maintain your pet’s health due to any act or omission on your part, we may end the contract immediately by giving notice to that effect.
23. We hope to provide you with an exceptional service (and we will always provide the Services with reasonable skill and care), but in the event you have any questions or complaints about the service offered please contact us in the first instance. We have a complaints procedure, details of which are available on request.
24. This contract will commence on the activation date noted in clause 10 above.
Either party may terminate this contract and end your Care4Pets Healthcare Plan at any time by giving the other at least one month’s advance notice.. We will advise you of your last direct debit payment date.
25. In the unfortunate event of your pet’s death, the Care4Pets Healthcare Plan can be stopped. Please contact your Vets4Pets practice as soon as possible after your pet’s death. It may not be possible to stop the Care4Pets Healthcare Plan before the next direct debit payment is due.
26. No refunds are payable for the months paid before a pet’s death.
27. We may vary the terms and conditions of this contract at any time and will provide one month’s written notice of any material changes. Such variation may include but is not limited to changes to the products, services and treatments covered by the Care4Pets Healthcare Plan. If you do not wish the contract to continue having regard to any change notified to you, you may terminate this contract without payment of a cancellation fee prior to any change coming into effect.
28. Each provision of this contract shall be construed separately and notwithstanding that the whole or any part of any such provision may prove to be illegal or unenforceable the other provisions of this contract and the remainder of the provision in question shall continue in full force and effect.
29. Except where we have been negligent or have caused death or injury to a person we shall only be responsible for losses that you suffer that are a reasonably foreseeable consequence of our breach. Neither we nor you shall be liable to (whether in contract, tort, negligence or otherwise and howsoever arising) under this contract for: any trade or business losses; and/or for any delays or failures to perform that were caused by events beyond our reasonable control.
30. Subject to clause 31 below, our total liability to you (whether in contract, tort, negligence or otherwise and howsoever arising) shall in no event exceed twice the value of treatment, services and products covered by the Care4Pets Healthcare Plan only and paid for by you over the period of this contract.
31. Nothing in this contract seeks to limit or exclude our liability to you for: death and/or personal injury to any person caused by our negligence; and/or for any other matter that cannot be restricted and/or excluded.
32. This contract shall be subject to the laws of England and Wales and each party agrees to be bound by the non-exclusive jurisdiction of those courts.
